Judges criticize Trump administration’s legal tactics

This week, judges expressed frustration with the Trump administration in multiple court cases. U.S. District Judge James Boasberg hinted at contempt proceedings due to the administration’s failure to comply with his orders. Another judge in Maryland ordered a deportee accidentally sent to El Salvador to be returned to the U.S. The administration did receive a victory when the Supreme Court allowed it to terminate Education Department grants that the lower court had restored.

Boasberg criticized the government for using bad faith tactics and inaccurate claims concerning the deportation of alleged Venezuelan gang members under the Alien Enemies Act. This decision was made public after preparations were already underway to deport the individuals. In another case, a Maryland man who was mistakenly sent to El Salvador is due to return to the U.S. by Monday. The Justice Department showed negligence in knowing why he was sent there or the details of the decision.

In California, a federal judge blocked the administration from ending Temporary Protected Status for Venezuelan nationals. The judge criticized Homeland Security Secretary Kristi Noem for making an “unprecedented” decision motivated by unconstitutional animus. The administration’s disingenuous arguments and inaccurate claims in court cases were also highlighted by judges. The administration received some relief when the Supreme Court allowed it to terminate education grants that clashed with Trump’s policy.

Overall, the administration faced backlash from judges this week for its handling of legal cases, including accusations of bad faith, disingenuous arguments, and inaccurate claims.
