Senator Nicole Mitchell denies allegations of felony burglary • Minnesota Reformer


Senator Nicole Mitchell of Woodbury, who is currently serving her first term, pleaded not guilty to a first-degree felony charge on Wednesday. The charge alleges that she broke into her stepmother’s home in Detroit Lakes in April. Mitchell’s defense lawyer and the Becker County Attorney agreed that a laptop found in her possession could not be used as evidence of burglary, although it may still be used in the case.

Despite calls from her party, including Governor Tim Walz and DFL Party Chair Ken Martin, to step down, Mitchell has refused and continued to fulfill her Senate duties. She recently participated in the Minnesota State Fair while declining to discuss the charges against her.

The incident occurred when Mitchell was arrested at her stepmother’s house by Detroit Lakes officers investigating a burglary call. Mitchell was found dressed in black clothing in the basement, where she claimed to be retrieving her deceased father’s belongings since her stepmother had cut off contact with her and other family members.

The arrest took place during the 2024 legislative session, during which Republicans tried to prevent her from voting on bills. Despite being barred from DFL Senate caucus meetings and relieved of her committee assignments, Senate Majority Leader Erin Murphy has defended Mitchell’s right to due process and has not called for her resignation.

Mitchell’s next court hearing is scheduled for Friday as she continues to face the felony charge.
