Gravette man involved in Capitol riot could be released from prison ahead of schedule


Richard “Bigo” Barnett, a notorious rioter from the Jan. 6, 2021, Capitol riots, is appealing his case and seeking early release from prison. The federal government has decided not to defend one of his obstruction convictions, leaving him with seven convictions to address instead of eight. Barnett, who is currently imprisoned in Seagoville, Texas, became known for a photo of him with his foot on Speaker Nancy Pelosi’s desk during the riots.

Barnett’s appeal is being handled in the U.S. Circuit Court of Appeals for Washington, D.C. His defense attorney argues that a probationary report supports his request for release, despite disagreements with the guidelines calculation. The report states that his projected release date is now set for Sept. 30, 2026.

The defense argues that Barnett’s misdemeanor theft conviction for stealing an envelope from Pelosi’s office is not aligned with the seriousness of the case. Barnett claims he took the envelope because he cut his hand and left a quarter to pay for it, but he also carried a stun gun in the Capitol.

The prosecution opposes Barnett’s early release, citing security concerns and uncertainty about a potential resentencing to a term less than time already served plus the expected duration of the appeal process. Barnett’s defense maintains that a downward departure or variance to time served is appropriate, making immediate release suitable.
